This Terms and Conditions of Use Agreement (“Agreement”) is a legal agreement between you (“Client”) and Florida Property Photography (hereinafter referred to as “Website Owner”), the owner and operator of FloridaPropertyPhotography.com (“Website”). By registering for any service offered through the Website, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions outlined below (“Terms”).

The most current version of this Agreement will supersede all prior versions and can always be reviewed at FloridaPropertyPhotography.com/terms. Florida Property Photography reserves the right to modify or update these Terms at any time, with or without notice.

1. Limitations of Liability and Indemnification

By using any services provided by Florida Property Photography, you agree that in no event shall Florida Property Photography, the Website Owner, or any of their officers, employees, agents, affiliates, licensees, or hosting providers be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use of the Website or its services.

Your sole remedy for dissatisfaction with the services is a refund of any fees paid. You agree to indemnify and hold harmless Florida Property Photography, its affiliates, agents, employees, licensees, and hosting services from any claims, liabilities, costs, or legal expenses (including court costs, legal fees, settlements, or awards) arising from your use of the Website or services, or your violation of this Agreement.

2. Client Responsibility

You are solely responsible for your actions while using the Website. Florida Property Photography does not perform background checks or psychological evaluations of clients using its services. You agree to take reasonable precautions when interacting with others, including but not limited to: initiating contact via email, avoiding the disclosure of sensitive personal information, and meeting in public settings when appropriate.

3. No Reliance on Website Content

Any opinions, advice, or statements on the Website should not be considered professional or legal advice. Florida Property Photography makes no warranties regarding the accuracy, completeness, or reliability of the content provided and shall not be held liable for any reliance placed upon such information.

4. Offensive Content

While we strive to maintain a professional and safe environment, Florida Property Photography cannot guarantee that clients will not post or send inappropriate or offensive material. We are not responsible for such content or for any third-party misuse of your personal information outside of our control.

5. Right to Monitor

Florida Property Photography reserves the right—but is not obligated—to monitor public areas of the Website. We may remove any content deemed inappropriate or offensive at our sole discretion. However, you remain solely responsible for the information you post or share.

6. Confidentiality

All personal information provided to Florida Property Photography will be treated as confidential, with the following exceptions:

Basic biographical details (e.g., age, gender) may be shared alongside your user ID;
You voluntarily share your information with others;
Messaging another client may reveal your email address;
In cases of harassment, confidentiality protections may be waived.

7. Intellectual Property

All content, trademarks, copyrights, and proprietary materials on the Website are owned by Florida Property Photography. You may not reproduce, distribute, or transmit any material from the Website without express written consent. By submitting content to the Website, you confirm that you have the right to grant us permission to use it.

8. No Warranties

All services are provided “as is” without any express or implied warranties. Florida Property Photography makes no guarantee that the Website will operate uninterrupted, error-free, or meet your specific expectations. We disclaim any liability for technical failures or errors.

9. Jurisdiction

This Agreement shall be governed by the laws of the State of Florida. Any disputes arising from this Agreement will be resolved exclusively in the United States District Court for the Middle District of Florida. By using the Website, you consent to the jurisdiction and venue of such courts.

10. Severability

If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11. User Certification

You certify that you are at least 18 years old and that all information provided during registration is accurate and truthful. You acknowledge that some of your basic information may be visible to other users, but your name, address, and email address will remain confidential unless otherwise specified in this Agreement.

12. Entire Agreement

This Agreement constitutes the entire understanding between you and Florida Property Photography concerning the use of the Website and services. It supersedes any prior agreements or understandings.

13. Waiver

No waiver of any term or condition shall be deemed a further or continuing waiver of such term. Any waiver must be in writing and signed by an authorized representative of Florida Property Photography.
